1. Agreement to These Terms

Wilson & Associates, Inc., doing business as Wilson Publishing (“Wilson Publishing,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. Any consulting, editing, publishing, or other professional services we provide to you are governed by a separate written agreement, proposal, or statement of work. If there is a conflict between these Terms and a signed services agreement, the signed services agreement controls for those services.

The Site provides general information about the document, data, and process services offered by Wilson Publishing, including writing and editing, tools and document management, process and knowledge management, and related solutions. The Site also offers articles, a contact form, an email sign-up form, information about careers, and a link to a client login.

Information on the Site is provided for general informational purposes only. It is not professional, engineering, legal, or financial advice, and it does not create a client relationship or any obligation on our part to provide services.

3. Eligibility

AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

If you believe that material on the Site infringes your copyright, please send a written notice to the contact address below that identifies the copyrighted work, identifies the allegedly infringing material and where it appears on the Site, includes your contact information, states that you have a good-faith belief the use is not authorized, and states under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

17. General Provisions

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site. If any provision is found to be unenforceable, the remaining provisions stay in effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely. Headings are for convenience only.
